ORDINANCE #097-2

 

Title:  Damage To and Materials Deposited on Roadway

 

1.  Authority

 

This ordinance is adopted pursuant to the general powers granted under Section 60.22 (3) and 61.34 (1) Wisconsin Statutes.  Additional authority is noted under 81.36 (1)(2), 86.01 and 346.94(5)(7) Wisconsin Statutes.

 

2.  Purpose

 

The purpose of this ordinance is to promote the public health, safety and general welfare of the traveling community and to protect them from controllable highway hazards.

 

3.  General Provisions

 

a.       No snow or ice removed from private property shall be deposited in the public roadway in areas expected to be cleared by personell from the Town; nor shall ice or snow be deposited on the public roadway after the roadway has been cleared by the Town.

 

The following actions are prohibited:

 

1.      Pushing snow or ice across a roadway and leaving a deposit of any kind.

2.      Pushing or carrying and depositing snow or ice on a public roadway where it is expected to be maintained for pedestrian or vehicular traffic by the Town.

3.      The blowing of snow or ice on to a pedestrian or vehicular traveled area.

 

b.      Deposits of mud, stones, manure or other foreign materials that are dropped or lost from farm machinery, contractor equipment or other types of over-the-road vehicles is prohibited and must be cleared off of the road surface before it becomes a safety hazard.

 

c.       Any person show shall operate or cause to be operated any type of equipment on town roads that damage or injury’s said road, shall be held responsible for the full cost of the repairs required to return the roadway to the condition prior to the damage.

 

4.  Effective Date

 

This ordinance shall take effect and be in force after its passage by the Town Board of Supervisors of the Town of Berry
